Terms and Conditions – Instagram Competition

Competition Organizer

The organizer of this competition is SMF Holding GmbH, Siegener Straße 10, 57612 Eichelhardt / Germany (hereinafter referred to as the "Competition Organizer"). SMF Holding GmbH is responsible for data protection and the point of contact for questions regarding the competition.

Eligibility

All natural persons aged 18 years or older with a residence in Germany are eligible to participate. Employees of SMF Holding GmbH and affiliated companies, as well as their family members, are excluded. A purchase of goods or services from the organizer is not required. A valid Instagram account and internet access are required.

Notification, Response, and Shipping

Winners will be informed via Instagram direct message. They must respond within 48 hours to accept the prize. If no response is received within this period, a new winner will be determined. The participant is responsible for the accuracy of their Instagram details. In the event that the competition prize is to be sent to the winner by post, the provision and use of the postal address are required. Exclusion and Premature Termination

Participants who violate these terms and conditions or are suspected of manipulation will be excluded. The Competition Organizer reserves the right to terminate or adapt the competition at any time for technical or legal reasons if proper execution cannot be guaranteed.

Publication of Winners

The winners of the competition will be published on the "Group Schumacher" channel. This is done on the basis of a legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR, particularly for transparency and traceability of prize awarding. Liability

The Competition Organizer assumes no liability for technical failures, transmission errors, or data loss. This does not apply to damages to life, body, or health, or in cases of intentional or grossly negligent conduct.

This competition is not affiliated with Instagram and is neither sponsored, supported, nor organized by Instagram. Instagram is not a point of contact for this competition. Data protection

Participation in the competition requires the Competition Organizer to process the necessary data (e.g., Instagram username, comment) within the scope of participation. This is done exclusively for the purpose of conducting the competition. The legal basis is Art. 6 para. 1 lit. b GDPR (fulfillment of a contractual relationship). The publication takes place on the organizer's communication channel, Instagram.

Recipients of the data may include both internal departments (e.g., marketing department, customer service, IT) and external service providers (e.g., agencies, web hosts, social media platforms, and possibly postal service providers) commissioned with the execution or communication of the competition. Furthermore, the general public is the recipient of the published information.

After the competition has ended, the data will be deleted, unless there are legal retention obligations. Participants have the right to information, rectification, erasure, and restriction of the processing of their personal data. In addition, there is a right to lodge a complaint with the competent data protection supervisory authority.
